Important: Please read these rules before entering this online promotion (the "Promotion").
By participating in the Promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.

Official Rules, Restrictions, and Release of Liability

PARTICIPATION IN THIS CONTEST (the “Contest”) CONSTITUTES YOUR ACKNOWLEDGMENT AND AGREEMENT THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF THE CONTEST RULES HEREIN:

No purchase or contribution necessary to enter. Contest void where prohibited by law. All federal, state, and local laws and regulations governing such contests apply. Contest limited to legal residents of the United States who are at least 18 years of age. The sponsor of the contest is the California Democratic Party (FPPC ID# 741666) (“Sponsor”). Making a contribution will not improve your chances of winning. The Sponsor will also distribute entries in a general and indiscriminate manner. To enter without making a contribution, send a stamped, self-addressed envelope with name, address and phone number to: California Democratic Party, 1830 9^th Street, Sacramento, CA 95811.

All entrants who choose to contribute to the California Democratic Party must adhere to federal and state contribution limits and prohibitions as set forth on the website of the Federal Elections Commission: https://www.fec.gov/help-candidates-and-committees/candidate-taking-receipts/who-can-and-cant-contribute/; and the Fair Political Practices Commission: http://www.fppc.ca.gov/learn/campaign-rules/state-contribution-limits.html. Contributions to the California Democratic Party are not tax deductible. A contributor must be a U.S. Citizen or lawfully admitted permanent resident (i.e. green card holder). All entrants who choose to contribute must also provide the Sponsor with their name, address, occupation, and employer information for campaign reporting purposes. Entrants are responsible for their own campaign reporting obligations, if applicable.

All entries, either online or mail-in, must be received by 11:59:59 PM Pacific Time, [November 16], 2019. Winner(s) will be notified by November [17,] 2019, via phone or email, or via social media. You need not be present to win. One winner will receive a California Democratic Party tote bag signed by twelve Democratic Presidential Candidates and other California elected officials, including but not limited to Speaker Nancy Pelosi and Governor Gavin Newsom (the “Signed Bag”).

The Sponsor will deliver, in person or via UPS or FED-EX, the Signed Bag at a location designated by the Contest winner. The estimated financial value of the Signed Bag is approximately [$50.00].

ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF ANY WINNER. The prize may be forfeited and awarded to an alternative winner if (a) the winner affidavit and release materials are not returned as required from the potential winner, (b) if two (2) attempts to contact the potential winner by phone, social media, and/or e-mail are not successful, (c) any prize is otherwise not claimed.

Winner(s) will be chosen at random. Odds of winning dependent upon number of eligible entries received. No substitutions or cash alternatives offered. Prize is non-transferrable: By participating, contestants agree to accept the Signed Bag. The Signed Bag is awarded "AS IS." No warranties, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), are created by entry except the award of a prize to holder or winning entry. The Sponsor is not responsible for computer, software, network, or transmission problems or late, lost, or misdirected entries or other submission errors. The Sponsor has the right to terminate, cancel, or modify the contest at any time.

In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

General Release

By entering the Contest, you release Sponsor and all released parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty, or other theory.

Except where prohibited by law, entry into the Contest constitutes permission to use winner's name, hometown, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation. You also hereby grant Sponsor a perpetual, irrevocable, worldwide, royalty-free right, and license (the "License") to reproduce, distribute, display, perform, adapt, modify, create derivative works of and otherwise use and exploit photos of the Contest winner and or the Contest winner with the Signed Bag. This License may be sublicensed or assigned by Sponsor in Sponsor’s sole discretion. By entering the contest you represent and warrant that: you are 18 years of age or older.

As a condition of being awarded any prize, except where prohibited by law, winner may be required to execute a consent to the use of his or her name, hometown, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, winner may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules, Restrictions, and Release of Liability, and any other legal, regulatory, or tax-related documents required by Sponsor in its sole discretion.
